Appeals Court Rules in Favor of Lab in Dee Kotla Case: Decision Overturns Earlier Judgment

The Laboratory has learned today that the California Court of Appeals, First Appellate District, has overturned the judgment in the civil suit, Dee Kotla vs. the Regents of the University of California.

During the trial both Lawrence Livermore National Laboratory and the University of California raised questions regarding prejudicial evidentiary errors in the case. Following the trial, an appeal was filed. Today's decision by the court validates the questions raised by both the Lab and UC.

As a result of the court's decision, the judgment in the trial case is reversed and the case is being remanded to the trial court for further proceedings consistent with the appellate court's decision, including a new trial.
